Terms of Service
Last updated: October 21, 2026
These Terms of Service ("Terms") are an agreement between you and Jobsite, operated by Jobsite LLC, an Arizona limited liability company ("Jobsite," "we," "us"). By creating an account or using the Jobsite platform, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the service.
1. Who can use Jobsite
- Companies. Construction companies subscribe on behalf of their workers. The person who signs up must be authorized to bind the company.
- Workers. Workers are added to a company's roster by that company. Workers don't sign up directly; they receive a PIN from their employer and log in at
/{companyCode}. - You must be at least 16 years old to use Jobsite.
2. What Jobsite provides
Jobsite is a hosted, self-service software platform for construction safety and project management. Depending on your plan, it provides:
- Training delivery and records — a library of safety training courses and quizzes, tools to assign them, and records of completion.
- Certification and credential tracking — records of training completions and of externally issued credentials your company enters, their expiration dates, and reminders as they approach.
- Safety program tools — job hazard analyses, inspections and custom forms, incident reports and OSHA 300/300A/301 recordkeeping, toolbox talks, safety observations, and a compliance calendar.
- Project tools — jobs, daily logs, drawings, RFIs, submittals, punch lists, schedules, budgets, contracts, and related records.
- A worker portal and worksite kiosk — sign-in, time tracking, and a worker's access to their own training and records.
- Messaging, notifications, reports, and integrations with third-party systems you choose to connect.
We provide the platform, its hosting and updates, and email support at support@jobsitecerts.com. We do not provide on-site services, safety consulting, legal advice, or any guarantee of a regulatory outcome — those remain your responsibility (see Section 8). Features vary by plan and change over time; the in-app product guide describes the current feature set.
3. Your account
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Tell us immediately at support@jobsitecerts.com if you suspect unauthorized use.
4. Company responsibilities
When your company adds a worker to Jobsite, the company represents and warrants that:
- The company has a legitimate employment or contractor relationship with the worker.
- The company has the right under applicable law to share the worker's name, email, and phone number with Jobsite for compliance-management purposes.
- The company has informed the worker that Jobsite will contact them by text or email about safety training and certifications.
You confirm these representations each time you add workers — one at a time or by import — and we record that confirmation. The worker's own reply YES to Jobsite's opt-in message is the legally binding consent that authorizes ongoing SMS alerts. The company's upload of a phone number alone is not treated as consent on the worker's behalf.
5. Worker responsibilities
- Keep your 4-digit PIN private. Don't share it with co-workers.
- Complete training honestly. Don't have someone else take a training or quiz for you.
- Keep your contact information current through your employer.
6. SMS messaging
Jobsite's SMS program and opt-in mechanics are described in detail on the SMS Opt-In page, which forms part of these Terms. Key points:
- Workers opt in through a dedicated, optional SMS consent checkbox during account setup, then by replying YES to a single confirmation message (double opt-in).
- Workers opt out by replying STOP at any time.
- Message and data rates may apply.
- Message frequency varies; typical range is 1–6 messages per month.
7. Acceptable use
You agree not to:
- Use Jobsite to violate any law or regulation (including OSHA, state labor, or privacy laws).
- Upload phone numbers or email addresses of people you are not authorized to contact.
- Falsify training completions, quiz results, or inspection records.
- Attempt to access another company's data, probe for vulnerabilities, or circumvent rate limits.
- Resell, sublicense, or white-label Jobsite without a written agreement with us.
To report content on Jobsite that infringes your copyright or trademark, or that is defamatory or otherwise unlawful, see our Copyright and Content Complaints page, which describes our notice-and-takedown procedure and our repeat-infringer policy.
8. Training content and decision support
Jobsite's training content, and every other output the platform produces — including recordability guidance, generated hazard analyses and inspection forms, compliance status and expiration reminders, risk scores, and answers from Ask Jobsite — are tools to support your own compliance program. They are designed to align with OSHA and industry guidance, but Jobsite does not guarantee that completing a training course, following a suggested classification, or relying on any reminder or status will satisfy any specific legal or regulatory obligation.
Jobsite is not a law firm, a safety consultancy, or a licensed safety professional, and nothing it produces is legal, medical, or professional safety advice or a substitute for the judgment of your designated competent or qualified person. Your company remains responsible for confirming that the training it assigns meets its own requirements; for making and documenting its own recordkeeping decisions; for keeping worker, credential, and training records current, including entering renewals and correcting errors; and for site-specific safety instruction, supervised on-the-job training, and state-mandated programs where those are required. Jobsite does not control your worksites and is not responsible for injuries, property damage, citations, or penalties arising from conditions or decisions there.
9. Fees and cancellation
- Subscription fees, free trial terms, and billing cycle are shown at signup and in your account settings.
- You may cancel at any time. Cancellation takes effect at the end of the current billing period; no partial refunds.
- We may suspend or terminate an account for non-payment, breach of these Terms, or misuse that threatens other users.
9A. Customer payments, disputes and chargebacks
This section applies when your company accepts payments from its customers through Jobsite (for example an invoice or an estimate deposit paid by card or bank account).
- How payments move. Stripe processes those payments on Jobsite's platform account and Jobsite pays them out to your company's connected Stripe account. Your use of Stripe is also subject to Stripe's own terms.
- Your responsibility. Your company is responsible for its work, its pricing, any refund it promises, and for disputes, chargebacks and reversals of those payments. A customer can dispute a payment with their bank long after it is paid.
- Responding to a dispute. You authorize Jobsite to respond to a dispute on your behalf, using the records in your Jobsite account and the explanation you provide, and to share those records and that explanation with Stripe and the card networks and banks involved, for that purpose. A response can be sent once. Jobsite does not guarantee any outcome; the customer's bank decides.
- If the bank decides against you. Jobsite may recover the disputed amount and any fees Stripe charges for the dispute, by reversing the related payout transfer, debiting your connected Stripe balance, or offsetting future payouts. If Jobsite cannot recover an amount that way, Jobsite may invoice you for it, and you agree to pay it.
- If you win. Nothing is taken from you. Jobsite absorbs any fee Stripe keeps on a dispute that is decided in your favor.
- Bank-account (ACH) payments. Disputes and returns on bank-account payments generally cannot be contested; the customer's bank decides, and the recovery described above applies.
- Your records and deadlines. Keep accurate records of your work, estimates, invoices and customer communications, and respond to a dispute by the deadline shown on the service call. A response after the deadline cannot be submitted.
10. Data ownership
Your company owns the data it puts into Jobsite (worker roster, training records, worksites, forms). We act as your processor for that data. We keep your data after you cancel, so it is still there if you come back, and you can still sign in, look it up, and download an export of its main records (listed on our Security & Privacy page). When you want it deleted, email privacy@jobsitecerts.com and we will delete it within 30 days of your request, except where law requires us to retain it.
11. Disclaimers
Jobsite is provided "as is" and "as available." We disclaim all warranties to the fullest extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that every message or email will be delivered. Descriptions of our security and privacy practices, including on our Security & Privacy page, describe our current practices and are provided for information; they are not warranties and are subject to Section 12.
12. Limitation of liability
To the maximum extent permitted by law, Jobsite's total aggregate liability for all claims arising out of or relating to these Terms or the service is limited to the amount you paid us in the 12 months preceding the first event giving rise to the claim. We are not liable for indirect, incidental, special, exemplary, consequential, or punitive damages, or for lost profits, revenue, business, or data, even if we were advised of the possibility of such damages. These limits apply regardless of the theory of liability and even if a remedy fails of its essential purpose.
13. Indemnification
You agree to indemnify and hold Jobsite harmless from claims arising out of (a) your misuse of the service, (b) data you upload, including phone numbers or emails for which you lacked authority to contact, or (c) your violation of these Terms or applicable law.
14. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email to account owners at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms. When you accept these Terms — at signup, when they change, or as a worker on first login — we record the version accepted, the date and time, and the network address used, as evidence of the agreement.
